Terms of Service

1. Agreement to Terms

By accessing or using the Websites Factory platform ("Service"), operated from Melbourne, Australia, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

2. Services

Websites Factory provides AI-assisted website creation services, including:

  • AI-powered requirements collection via online chat
  • Custom website design, content writing, and development
  • Domain name registration (in the Client's name)
  • Website hosting, deployment, and ongoing maintenance
  • Logo generation (if the Client does not have one)

3. Packages and Pricing

All prices are in Australian Dollars (AUD) and include GST where applicable.

  • Monthly ($99/mo) — Recurring subscription, cancel anytime. Hosting, domain, and maintenance included.
  • Starter ($1,499) — 50% deposit upfront, 50% balance before delivery. First year hosting, domain, and maintenance included.
  • Business ($7,999) — 50% deposit upfront, 50% balance before delivery. First year hosting, domain, and maintenance included.

For Starter and Business packages, ongoing hosting and maintenance from year 2 is available at $29.90/mo or $299/yr. This covers hosting, domain renewal, security updates, bug fixes, and technical consultation. Content changes (text, images, layout) are available at $30 per request (work within 1 hour).

We reserve the right to modify pricing. Any price changes will not affect existing orders or active maintenance plans.

4. Payment Terms

  • Card payments are processed securely via Stripe
  • Business package also accepts bank transfer for deposits
  • For project packages (Starter/Business), a 50% deposit is required to begin work
  • The remaining 50% balance is due before final website delivery
  • Monthly subscriptions are billed on a recurring basis until cancelled

5. Digital Contracts

Before payment, you will be presented with a project contract specific to your chosen package. By typing your full legal name and proceeding to payment, you digitally sign and agree to the contract terms. Signed contracts are stored securely and a PDF copy is emailed to you.

6. Cancellation and Refunds

  • Monthly: Cancel anytime from your dashboard. No refund for the current billing period.
  • Starter/Business: Deposits are non-refundable once work has commenced. If we are unable to deliver the agreed-upon website, a full refund will be provided.

All refund policies are subject to the Australian Consumer Law. Nothing in these Terms excludes or limits your rights under the Australian Consumer Law.

7. Your Responsibilities

  • Provide accurate business and contact information
  • Respond to requirements questions in a timely manner
  • Ensure you have rights to all content (text, images, logos) you provide
  • Review deliverables and provide feedback within 14 days
  • Keep your account credentials secure

8. Intellectual Property

Ownership depends on your package:

  • Starter/Business: Upon full payment, you own the website source code, design, and all custom content. You may host the website independently.
  • Monthly: You own your content (text, images, logo) but not the underlying source code. The website is hosted and managed by us during your active subscription.

We retain the right to:

  • Display the completed website in our portfolio (unless otherwise agreed)
  • Retain ownership of our underlying tools, templates, and AI systems
  • Use anonymised data to improve our services

9. Domain Names

  • We register a custom domain name on your behalf as part of your package. The domain is registered in your name — you are the legal owner.
  • Monthly: Domain registration and renewal are included in the $99/mo subscription. On cancellation, you have 30 days to request a domain transfer. If no transfer is requested, the domain will not be renewed.
  • Starter/Business: First year domain registration is included. From year 2, domain renewal is included in the ongoing maintenance plan ($29.90/mo or $299/yr).
  • You may also choose to register and manage your own domain. In this case, we will deliver the source code and assist with DNS configuration.

10. AI-Generated Content

Parts of your website may be generated or assisted by artificial intelligence. While we review all AI output for quality, you acknowledge that AI-generated content may require your review and approval. We are not liable for AI-generated content that you approve and publish.

11. Limitation of Liability

To the maximum extent permitted by Australian law, Websites Factory shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you for the Service.

12. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance or updates that temporarily affect availability. We will notify you of planned downtime where possible.

13. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on our website. Continued use of the Service after changes constitutes acceptance of the updated Terms.
